Terms of Use

These terms apply to your use of the Upheld app and website, provided by Midpoint Software Group ("we," "us"). By creating an account or using Upheld, you agree to these terms. If you download Upheld from the Apple App Store, Apple's Standard End User License Agreement also applies.

1. What Upheld Is

Upheld helps parents and advocates organize IEP and 504 plan information, keep a record of whether services were delivered, prepare for meetings, and find help. Upheld is an organizing tool. It does not give legal, educational, or medical advice, and it is not affiliated with any school, school district, or government agency. For advice about your child's rights, talk to a qualified professional.

2. Your Account

You must be at least 18 years old to create an account. You are responsible for keeping your login secure and for activity under your account. Please give accurate information when you sign up.

3. Your Information

You own the records, notes, recordings, and documents you add to Upheld. You give us permission to store, process, and display them only as needed to run the app for you and the people you choose to share with. Our Privacy Policy explains how we handle your information.

Only add information about a child if you are that child's parent or legal guardian, or you have the parent's or guardian's permission. Only record your own voice notes; do not use Upheld to record other people without their knowledge.

4. Voice Memo Suggestions

When you record a voice memo, Upheld may suggest log entries based on what you said. Suggestions can be wrong. Nothing is saved to your records until you review and confirm it, and the original audio stays with the entry so you can check it.

5. Advocates and the Advocate Directory

Advocates create their own profiles. We check that profiles are real and complete before they appear, but we do not recommend, endorse, license, or supervise any advocate, and we are not responsible for their advice or services. Any arrangement between you and an advocate, including fees, is between the two of you. Please ask about an advocate's experience before sharing your child's records.

If you list yourself as an advocate, you agree that your profile is accurate, you will not promise guaranteed outcomes, you will not claim to be a lawyer unless you are one, and you will keep any family's information you receive private.

6. Subscriptions

Some features require a paid subscription, purchased through Apple. Subscriptions renew automatically at the end of each period unless you turn off auto-renew at least 24 hours before the period ends. Payment is charged to your Apple ID account. You can manage or cancel your subscription in your Apple ID account settings. Refunds are handled by Apple under Apple's policies.

7. Acceptable Use

Do not use Upheld to break the law, harass anyone, upload content you don't have the right to share, try to access other people's accounts or records, or interfere with the app's security or operation.

8. Ending Your Use

You can stop using Upheld and delete your account at any time. We may suspend or close accounts that break these terms, including advocate profiles that mislead families.

9. Disclaimers and Limits

Upheld is provided "as is." We work to keep it available and accurate, but we cannot promise it will always be error-free or uninterrupted. Keep your own copies of important documents, such as your child's signed IEP. To the extent the law allows, we are not liable for indirect or consequential losses arising from your use of Upheld.

10. Changes

We may update these terms. If we make important changes, we will update the date at the top of this page. Continuing to use Upheld after a change means you accept the updated terms.
